WHAT IS A PRE-PURCHASE SURVEY?

If you are purchasing a property built before 2000, you may be required to carry out a pre-purchase asbestos survey. Our pre-purchase asbestos surveys are based on the two standard types of survey,  namely a Management Survey or an R & D Survey (Refurbishment & Demolition). Your choice of survey depends on your future plans for the property you wish to buy.

If you are moving into the property and would like to know if asbestos is present, you will require a Management Survey to identify any asbestos-containing materials (ACMs). This survey is a non-intrusive survey therefore no damage is caused to the property. The main reason for this is that the owner/vendor of the property is unlikely to allow us to undertake a fully intrusive survey (Refurbishment & Demolition Survey) at this point when you, the buyer do not own the property.

R & D SURVEY

When planning any refurbishment works, such as minor home improvements (knocking through walls or removing ceilings) to major renovation works (building extensions, basements or doing a loft conversion) you will require a Refurbishment & Demolition Survey.

If you are intending to demolish the building in question, these circumstances will demand that a more intrusive survey be undertaken. At this point, ALL ASBESTOS will require confirmation from the owner/vendor that they consent to a fully intrusive survey on the property.

Is it illegal to sell a property with asbestos?

It’s not illegal to sell a property that contains asbestos, although you will have to disclose its presence if you are already aware of it. The Property Misdescriptions Act of 2013 states that it is an offence to withhold such information, and failing to abide by the law could invalidate the sale and result in prosecution.

If a buyer’s survey uncovers asbestos and you were previously unaware of it, there are no repercussions. There are no laws stating that you need to be aware of asbestos in your property before a sale.

Buyers certainly shouldn’t be put off altogether if the home they wish to buy turns out to contain asbestos. Although asbestos is proven to be a hazardous material that can cause numerous health-related problems, that doesn’t mean you should pull out of the deal.
